This agreement states the terms and conditions that govern your use of the site and application of all services; gift cards, credits and resources available or enabled via the site, and your purchase of products and goods sold through our services.  By accessing and using any of the services, you are indicating that you accept and agree to comply with, this agreement. If you do not accept this agreement, you are not permitted to, and you must not, access or use the services or purchase products from James Michelle LLC or any of its subsidiaries.


By signing up for a James Michelle Account (as defined below) or shopping online, you represent, acknowledge and agree that you are at least 18 years of age, or if you are under 18 years of age but are at least 13 years old, that you are using the Site with the consent of your parent or legal guardian and that you have received your parent’s or legal guardian’s permission to enter into this Agreement. If you are a parent or legal guardian who is registering for a child, you hereby agree to bind your child to this Agreement and to fully indemnify, release and hold harmless James Michelle if your child breaches or disaffirms any term or condition of this Agreement.

Changes to the Services: James Michelle may add to, change or remove any part of the Site, including, without limitation, any Content (as defined below) therein, at any time without prior notice to you.

Personal Information: Customers agree to provide accurate, current, and complete information as required for the purchase of the Products and Services (both as defined below in Section 3a). Reformation reserves the right to block further sales to Customers who provide false, inaccurate or incomplete data. Customer acknowledges that James Michelle uses a third party payment processing service to process orders and bill fees to your credit, debit, or other Company accepted payment method (“Payment Method”).

Privacy: By using any Services and/or purchasing any of our products at Retail or any other venue you consent to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in detail in our Privacy Policy (available for your review at https://www.jamesmichelle.com/pages/privacy). Irrespective of which country you reside in or supply information from, you authorize James Michelle to use your information in the United States and any other country where James Michelle operates as described herein. Accordingly, please be sure to read our Privacy Policy before using the Services, purchasing products, or submitting information to us. Passwords: You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.  You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that James Michelle is not responsible for third party access to your account that results from theft or misappropriation of your account.



Payment must be made by one of the methods you have selected during the checkout process (being VISA, MasterCard, American Express or Paypal).  The name on the card must be the same as the name of the person placing the order. If we do not receive the authorization that the payment has been processed we reserve the right to cancel your order. The value of your purchase will be settled from the applicable card or payment method when the order is placed.  If your payment cannot be processed you will be notified of this. You will then need to contact your card issuer and endeavor to resolve the issue.

Separate charges for shipping will be shown in your order receipt confirmation email and can be viewed during the checkout process before finalising your order.  For further information about shipping and handling charges, see [Shipping Information].


From time to time we have special offers that can be applied to your order by using a promotional code that we provide to you. In order to take advantage of these promotions, you must enter the promotional code in the space provided in your shopping  bag and hit the "apply" button. The value of the promotion will be applied to your order automatically. Please note only one promotional code may be used per transaction. Promotional codes cannot be used for the purchase of a gift voucher. Promotional codes are not valid for redemption anywhere except in the E-BOUTIQUE and cannot be exchanged for cash.  Delivery charges are excluded from the calculation of % off discount promotional codes. Unless otherwise specified each promotional code may only be used once per customer. Promotional codes cannot be applied to orders placed prior to or after the promotional period specified.


You may purchase gift vouchers from the website in the form of E-Gift cards that are sent in an email. They are not redeemable for cash and can only be used to purchase products from the site. They cannot be used to purchase another E-Gift card or purchased with a promotional code. E-Gift cards are partially redeemable and it is up to the cardholder to use the full value within the validity period. Any unused balance will not be refunded or credited when the card expires. When the cost of a purchase exceeds the available card balance, the cardholder will be required to make up the difference with an alternate form of payment. Gift Cards should be treated like cash. We disclaim all responsibility for lost or stolen E-Gift cards.



If any the provisions in these Terms of Use are deemed invalid or otherwise unenforceable, that condition shall be deemed several and shall not affect the enforceability of the remaining provisions.
